If you are a business owner, you are probably left with one final question: How do I file a PERM? In this post, we will dive deep into each step required in the PERM labor certification process to ensure you know what you need to file.<\/p>\n

Three <\/strong>Initial Steps<\/strong><\/h3>\n

Obtaining a PERM labor certification can be divided into three initial stages: determining the open position, filing and receiving the prevailing wage from the Department of Labor, and then recruiting candidates for the job. Although these steps are time-consuming and detail-oriented, it is necessary to participate in these processes to ensure that your PERM labor certification is approved.<\/p>\n

1. Identify the open position<\/strong><\/h3>\n

The first step in the PERM labor certification process requires you to determine that there is an open, permanent, and full-time position in your company. The details of this position will be important throughout the entire PERM process, so it is a good idea to establish the job title, job responsibilities, and the education and experience requirements. 2. Determination of the prevailing wage<\/strong> Once your company has identified a full-time, permanent job position that could be filled by a foreign candidate, the first step in filing the PERM labor certification is to determine \u00a0the prevailing wage<\/strong>, or the average hourly wage for US citizen workers in a specific job and location. This ensures that US workers' wages will not be depressed if foreign nationals are hired for a similar job in their area. Determining the prevailing wage also gives you an idea of the minimum you must pay the foreign candidate. To obtain the prevailing wage, you must submit Form ETA-9141, or the Application for Prevailing Wage Determination, to the National Prevailing Wage Center. This form requires you to fill out information about the job offer, job description, and job requirements, as well as the job location. You can submit this form electronically with the Department of Labor's FLAG system. <\/strong> Once the form is submitted, you will receive a prevailing wage determination from the National Prevailing Wage Center after a couple of months, although processing times vary. This determination considers the job duties, required education and experience, and the job location to determine the minimum salary you must pay your employee. Once you receive the prevailing wage determination, you can move on to the next step in the PERM labor certification process: recruitment.<\/strong><\/p>\n

3. R<\/strong>recruitment<\/strong><\/h3>\n

Before filing the PERM labor certification, your company must participate in a recruitment process, which allows it to determine if there are candidates qualified, qualified, or willing US citizens<\/strong> in your area. To spread the word that your workplace is hiring, you must advertise the available job position. The recruitment process for \u201cprofessional\u201d jobs differs from \u201cnon-professional\u201d jobs. For professional jobs, you must submit the following:<\/p>\n
