Atteberry<\/strong>\n\nThe United States of America was founded on the idea that all people are created equal. These ideas are at the center of our Constitution and Bill of Rights, documents that date back to the formation of the United States. These documents, although they have been amended and reinterpreted over time, continue to dictate how our legal system and law enforcement operate.\n\nHowever, the human element is always a factor in the reality of our lives. Politics and personal beliefs, priorities, or prejudices often play a role in how laws are enforced or how much respect an individual's rights may receive in a given situation. You can never assume that law enforcement will protect your safety or respect your rights. For that reason, it is vital to know what your rights are and how to demand them. Perhaps especially for immigrants, it is important to be aware of the details of your rights in the United States, because others may assume you do not know them and try to take advantage of that.\n\nThese are some key components of the rights to which anyone in the United States is entitled, regardless of their citizenship or immigration status:\n\n<strong>The 4th Amendment: Your right to privacy<\/strong>\n\nMany rights that apply to anyone in the United States derive from the 4th Amendment. It reads:\n\n\u201c<em>The right of [...] shall not be violated <\/em><strong><em>the people<\/em><\/strong><em> to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.<\/em>\n<ul>\n \t<li>This passage does not refer to citizens, it refers to all people. It provides the right to refuse to be searched, questioned, or have one's property taken without probable cause, which means substantial evidence of a crime, and a warrant. Unless you are presented with an arrest warrant or other order signed by a judge, you retain this right.<\/li>\n \t<li>Even if the police have a warrant, you don&#x27;t have to answer any questions. Always remember that anything you say will likely be recorded and could be used in court.<\/li>\n \t<li>Your home\u2014your \u201ccastle\u201d\u2014is where you enjoy the greatest protection under this right. Unless they have a court order, you don\u2019t even have to open the door if a police officer or other government official knocks.<\/li>\n<\/ul>\n<strong>THERE ARE EXCEPTIONS:<\/strong>\n<ul>\n \t<li>In many states, <strong>You are required to provide your name to the police<\/strong> if they find you in a public place. This only applies if they have reason to suspect that you are committing a crime, but that can include things like loitering\u2014that is, if you&#x27;re just standing in a public place.<\/li>\n \t<li>In some states, you may also need to provide your address and\/or date of birth if stopped by the police.<\/li>\n \t<li>However, <strong>There is no state where he has to answer questions about where he was born or his immigration status.<\/strong><\/li>\n \t<li>If the police or another government official suspects that someone is in danger, they are allowed to enter without permission.<\/li>\n \t<li>If someone inside a house calls the police, or if anyone inside gives them permission, the police can enter to make sure no one is in danger.<\/li>\n \t<li>If the police are pursuing someone for a felony and believe the suspect is in your home or passed through it, they can enter without permission.<\/li>\n \t<li>If the police believe that evidence of a crime is being destroyed, they may enter without permission.<\/li>\n<\/ul>\n<strong>What to Do When Dealing with Law Enforcement:<\/strong>\n<ul>\n \t<li>Always stay calm and respectful.<\/li>\n \t<li>If a police officer or other law enforcement official enters your home by force, even without cause or a warrant, do not try to resist. To exercise your rights, tell them: \u201cI do not consent to you entering or searching my home. I am exercising my right to remain silent. I want to speak with a lawyer as soon as possible.\u201d.<\/li>\n \t<li>If government agents have an arrest warrant for you and there are other people in your home at risk of being detained, go outside to allow them to arrest you. If you let them in, they can interrogate anyone inside and potentially find evidence to detain others.<\/li>\n \t<li>Immigration agents need a warrant or a court order to enter and search a workplace. If they do so, your rights as a worker remain the same. You have the right to remain silent, and you can tell the agents that you are exercising that right.<\/li>\n \t<li>Customs officials may ask about your immigration status when you enter or leave the country. If you are a lawful permanent resident or have another status, you must answer. If you are not, it is best not to answer, although you will most likely be denied entry into the United States.<\/li>\n<\/ul>\n<strong>What You Need to Know If You&#x27;re Stopped While Driving:<\/strong>\n<ul>\n \t<li>Drivers and passengers have the right to remain silent. However, the driver must provide the police with a driver's license, proof of insurance, and registration if requested.<\/li>\n \t<li>When an officer stops you, you are being detained. To detain you, the officer must witness or suspect that you have committed a traffic violation or another crime.<\/li>\n \t<li>Similarly, Customs and Border Protection officers who operate vehicles throughout the United States must have reasonable suspicion that a driver or passenger in a vehicle has committed an immigration or customs violation, or a federal crime, in order to stop the vehicle.<\/li>\n \t<li>If a police officer or a CBP agent wants to search your car, you can refuse to give your consent. However, if they believe they will find evidence of a crime, they can search your car without your consent.<\/li>\n \t<li>Neither the police nor CBP can arrest you or detain you for an extended period without probable cause. You have the right to ask why you\u2019ve been detained, and they must answer you.<\/li>\n \t<li>If you are a passenger, you can ask the officer if you can leave. If you are given permission, remain calm as you leave. The officer may also ask anyone in the car to get out and detain them for questioning.<\/li>\n<\/ul>\n<strong>What to do if you are arrested: <\/strong>\n<ul>\n \t<li>Remember that you have the right to remain silent and the right to a lawyer. It is almost always in your best interest not to say anything until you have consulted with a lawyer.<\/li>\n \t<li>You can tell the officers who arrested you: \u201cI am exercising my right to remain silent. I want to speak with a lawyer as soon as possible.\u201d If they continue to question you, repeat this.<\/li>\n \t<li>Once you are arrested, you have the right to make a phone call to a family member or attorney, and the right to meet with your attorney while in custody. Memorize the phone numbers of the people you would like to call.<\/li>\n \t<li>You have the right to have your attorney accompany you to any hearing before a judge, whether it is a criminal or immigration hearing.<\/li>\n \t<li>If you are detained by CBP, you have the right to hire an attorney, but the government is not required to provide one for you. You can request a list of available legal counseling services that are free or low-cost.<\/li>\n<\/ul>\n<strong>Your Rights in the Workplace: <\/strong>\n\nDealing with law enforcement isn\u2019t the only time to consider your rights. In some situations, employers take advantage of people they know are undocumented or have precarious immigration status. Bad actors may use this against employees and traffic them, forcing them into involuntary labor or sexual acts. Human trafficking is illegal, and you have rights if your employer has put you in this situation or even attempted to do so.<strong> In some cases, violations of your rights in the workplace may make you eligible for immigration benefits. <\/strong>\n<ul>\n \t<li>Involuntary servitude occurs when an employer uses threats or violence to force you to continue working for them. This includes threats to report you to the police or immigration authorities, threats to withhold your pay, or threats to use violence against you if you do not do as they say. This constitutes human trafficking and may qualify you for T Nonimmigrant Status.<\/li>\n \t<li>You have the right to refuse to work under dangerous conditions without safety equipment or training. If you are forced or coerced into doing so, your rights have been violated.<\/li>\n \t<li>If your employer has withheld your pay, unfairly reduced it, or refused to pay you for all your hours, your rights have been violated.<\/li>\n \t<li>Being forced to work or provide sexual services to human smugglers may also qualify you for T nonimmigrant status.<\/li>\n \t<li>If your employer has violated U.S. labor laws, you can file a complaint so that the government can investigate. If you do so, you may qualify for Labor Violation Deferred Action (LVDA).
