This law has technically existed for decades, but it\u2019s now being actively implemented.\n\nWho Needs to Register?<\/strong>\n\nIf you fall into any of these categories, you might be required to register:\n
    \n \t
  • You are 14 or older, were not registered when you applied for a visa, and have stayed in the U.S. for more than 30 days.<\/li>\n \t
  • You\u2019re a parent or guardian of a foreign national under 14 who wasn\u2019t registered and has been in the U.S. for over 30 days.<\/li>\n \t
  • You turned 14 while in the U.S. and need to register within 30 days of your birthday.<\/li>\n<\/ul>\nWho Is Exempt?<\/strong>\n\nYou don't need to register if you:<\/strong>\n
      \n \t
    • Are you a Lawful Permanent Resident (LPR)?<\/li>\n \t
    • Have a valid work permit (EAD)<\/li>\n \t
    • Have filed for adjustment of status (I-485, I-687, etc.)<\/li>\n \t
    • Are already in removal proceedings<\/li>\n \t
    • Are you a Canadian visitor who entered the country legally?<\/li>\n<\/ul>\nWhat Are the Risks and Benefits of Registering?<\/strong>\n\n\u26a0\ufe0f If You Register:<\/strong>\n
        \n \t
      • Your information is on file with the U.S. government.<\/li>\n \t
      • It might make it easier for immigration authorities to track your status.<\/li>\n<\/ul>\n If You Don't Register:<\/strong>\n
          \n \t
        • You could face civil or criminal penalties (although it is unclear how these will be enforced).<\/li>\n \t
        • The government might use a lack of registration as a reason to deny future applications.<\/li>\n<\/ul>\nMore details on how to register will be available soon\u2014this will likely be done through a USCIS online account.\n

          1. What Happens if My VAWA, T Visa, or U Visa Case Is Denied? Am I at Risk of Deportation?<\/strong><\/li>\n<\/ol>\nThe Facts You Need to Know<\/strong>\n\n USCIS issued a new policy memo on February 28, 2025, outlining when a Notice to Appear (NTA) should be issued after a case is denied.\n\nAn NTA is the first step in initiating deportation proceedings, but here\u2019s what people don\u2019t realize\u2014just because you receive an NTA doesn\u2019t mean you\u2019re automatically in removal proceedings.\n\nWho Is Affected?<\/strong>\n\n\u2705 All case types are included, even VAWA, T Visa, and U Visa applicants. However, confidentiality laws still protect these applicants under 8 U.S.C. \u00a7 1367(a)(1).\n\n If you have a criminal history, your case may be referred to ICE, but this does not mean automatic deportation\u2014ICE would still need to take action.\n\n\u2696\ufe0f USCIS is being instructed to file fraud or misrepresentation charges more frequently\u2014but don\u2019t panic. This is not a new development, and if you\u2019ve been truthful in your application, you shouldn\u2019t worry.\n\nHere's the Catch:<\/strong>\n\n An NTA must be filed with the immigration court to actually initiate deportation proceedings. In 2018, a similar memo was issued, and there wasn\u2019t a huge spike in NTAs. \u23f3 Appealing a denial puts any deportation action on hold. The appeal process takes years\u2014by the time your case is decided, policies may have changed again.\n\nWhat Does This Mean for You?<\/strong>\n\n\u26a0\ufe0f This memo is intended to intimidate applicants. It does NOT mean you\u2019ll be immediately deported. Just because you receive an NTA doesn\u2019t mean you\u2019re in removal proceedings. \u23f3 Processing times for VAWA, U, and T visas take years.
