This law has technically existed for decades, but it is now being actively implemented.<\/p>\n Who needs to register?<\/strong><\/p>\n If you belong to any of these categories, you may need to register:<\/strong><\/p>\n Who is exempt?<\/strong><\/p>\n You do not need to register if:<\/strong><\/p>\n What are the risks and benefits of registering?<\/p>\n \u26a0\ufe0f If you sign up:<\/strong><\/p>\n If you do not register:<\/strong><\/p>\n Details on how to register will be available soon, likely through a USCIS online account.<\/p>\n The data you need to know<\/strong><\/p>\n USCIS issued a new policy memorandum on February 28, 2025, outlining when a Notice to Appear (NTA) must be issued after a case denial.<\/p>\n An NTA is the first step in starting deportation proceedings, but here is what people do not realize: the fact that you get an NTA does not mean you are automatically in deportation proceedings.<\/p>\n Who does it affect?<\/strong><\/p>\n \u2705 All case types are included, even VAWA, T Visa, and U Visa applicants. However, confidentiality laws still protect these applicants under 8 USC 1367 (a) (1).<\/p>\n If you have a criminal record, your case may be referred to ICE, but this does not mean automatic deportation; ICE would still have to take action.<\/p>\n \u2696\ufe0f USCIS is being told to add fraud\/misrepresentation charges more often, but don't panic. This is not new, and if you have been truthful in your application, you shouldn't worry.<\/p>\n Here is the trick:<\/strong><\/p>\n An NTA must be filed with the immigration court to initiate deportation proceedings. In 2018, a similar memorandum was issued and there was no major increase in NTAs. \u23f3 Appealing a denial halts any deportation action.
