Sometimes, ICE and certain government policies generate fear to push immigrants to leave voluntarily, without fully understanding the long-term consequences.<\/p>\n<h4><strong>The hidden costs of self-deportation<\/strong><\/h4>\n<p>According to the <em>National Immigration Project<\/em>, self-deportation can trigger legal and practical barriers that could prevent you from returning to the U.S. for years or even forever.<\/p>\n<ol>\n<li><strong> Long or permanent bans to return<\/strong><\/li>\n<\/ol>\n<p>If you have lived in the US without permission:<\/p>\n<ul>\n<li>More than 6 months but less than 1 year \u2192 3-year ban before being able to apply to return.<\/li>\n<li>More than 1 year \u2192 10-year ban.<\/li>\n<li>Certain cases (such as re-entry after deportation) can result in a permanent ban.<\/li>\n<\/ul>\n<p>These prohibitions apply even if you have family members in the US who can petition for you. Waivers exist, but they are difficult to obtain.<\/p>\n<ol start=\"2\">\n<li><strong> Consequences on your criminal and immigration record<\/strong><\/li>\n<\/ol>\n<p>Some convictions \u2014 even minor ones \u2014 can prevent you from obtaining a visa in the future. False claims to US citizenship or false information on immigration forms also carry lifetime bans with no possibility of a waiver.<\/p>\n<ol start=\"3\">\n<li><strong> Loss of the right to fight your case<\/strong><\/li>\n<\/ol>\n<p>If you leave while your immigration case is pending:<\/p>\n<ul>\n<li>Your application may be considered abandoned.<\/li>\n<li>Appeals are harder to follow from outside the country.<\/li>\n<li>In some cases, even winning an appeal does not guarantee that ICE will bring you back.<\/li>\n<\/ul>\n<p>For example, T visas (for victims of human trafficking) cannot be approved if the applicant is outside the country.<\/p>\n<ol start=\"4\">\n<li><strong> Fines and criminal charges for returning without permission<\/strong><\/li>\n<\/ol>\n<p>Re-entering the country without permission after being deported can result in heavy fines and federal prison time (up to 20 years in some cases). The new law <em>One Big Beautiful Bill Act<\/em> It also imposes a fine of $5,000 on those who are arrested after crossing without permission or failing to appear at their court hearing.<\/p>\n<h4><strong>Why having a pending case is better than self-deporting<\/strong><\/h4>\n<p>Even though the news may make it seem hopeless, having a pending case with USCIS or in immigration court is almost always better than having none at all. <strong>Reasons:<\/strong><\/p>\n<ul>\n<li>If ICE detains you, your attorney can request bond, fight deportation, or reopen your case.<\/li>\n<li>Pending cases can pause deportation in certain circumstances.<\/li>\n<li>Attorneys can file motions to oppose the reopening of old cases or to halt deportation orders.<\/li>\n<\/ul>\n<p>At our firm, we have secured the release of detained clients with pending T visas and other humanitarian applications.<\/p>\n<h4><strong>Options before considering leaving<\/strong><\/h4>\n<p>Before deciding to leave, talk to an experienced immigration attorney about all possible forms of relief, including:<\/p>\n<ul>\n<li>Asylum (fear of persecution in one's country)<\/li>\n<li>VAWA (for victims of abuse by U.S. citizens or permanent residents)<\/li>\n<li>U Visa (for victims of certain crimes who assist the authorities)<\/li>\n<li>T Visa (for victims of human trafficking)<\/li>\n<li>Cancellation of Deportation (for those who have resided in the U.S. for a long time and have a family member who is a U.S. citizen or permanent resident)<\/li>\n<li><em>Parole in Place<\/em> (for family members of military personnel)<\/li>\n<li>Special Immigrant Juvenile Status (for minors who have been abused, abandoned, or neglected)<\/li>\n<\/ul>\n<p><strong>How an immigration lawyer can help<\/strong> A lawyer can:<\/p>\n<ul>\n<li>Evaluate your eligibility for various forms of relief.<\/li>\n<li>File motions to reopen or halt deportation.<\/li>\n<li>Negotiate with ICE for your release or to have the case closed.<\/li>\n<li>Represent him in court and prepare a strong defense.<\/li>\n<li>Guide them through complex forms and documentation requirements.<\/li>\n<\/ul>\n<p><b>Remember:<\/b> The sooner you speak with a lawyer, the more options you may have.
