The <strong>Supreme Court decided to allow ICE to make arrests without the need for clear evidence<\/strong>, based on factors as superficial as the language you speak, your workplace, or even your physical appearance. This means that if you are an immigrant\u2014and especially if you speak Spanish, work in industries like construction, cleaning, or restaurants, or simply \u201clook foreign\u201d\u2014you could be at a higher risk of being detained. In this article, we explain: <img decoding=\"async\" draggable=\"false\" role=\"img\" class=\"emoji\" alt=\"\u2705\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/17.0.2\/svg\/2705.svg\"> What exactly did the Supreme Court decide. <img decoding=\"async\" draggable=\"false\" role=\"img\" class=\"emoji\" alt=\"\u2705\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/17.0.2\/svg\/2705.svg\"> How this ruling directly affects the immigrant community. <img decoding=\"async\" draggable=\"false\" role=\"img\" class=\"emoji\" alt=\"\u2705\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/17.0.2\/svg\/2705.svg\"> What you can do to protect yourself in the event of an encounter with ICE.<\/p>\n<h5><strong>What did the Supreme Court decide regarding immigrant detentions?<\/strong><\/h5>\n<p>Recently, the US Supreme Court, with a 6-3 majority, lifted the restrictions imposed by a district court in Los Angeles that prohibited federal immigration agents from detaining individuals <em>only<\/em> due to factors such as:<\/p>\n<ul>\n<li>What they look like (appearance or apparent ethnicity)<\/li>\n<li>The language they speak or if they have an accent when speaking English<\/li>\n<li>The type of work they perform (for example, informal work, car washing, construction, etc.)<\/li>\n<li>Being in certain places known for migrant workers gathering (bus stops, car washes, low-wage work areas).<\/li>\n<\/ul>\n<p>Until now, a judge, Maame E. Frimpong, had issued an order limiting these detentions, arguing that they violated the Fourth Amendment, which protects against arbitrary searches and seizures. That order had been upheld by the 9th Circuit. But now the Supreme Court has temporarily stayed that order while it reviews the appeals.<\/p>\n<h5><strong>Why does this decision affect so many immigrants?<\/strong><\/h5>\n<p><strong>This changes a lot of things in practice:<\/strong> ICE can now resume roving patrols in areas like Los Angeles without needing specific suspicion based solely on those mentioned factors. Spanish speakers, low-wage workers, those who do not speak English very well, those with an accent, those in certain jobs or locations known for migrant labor are at greater risk of being detained or questioned by ICE even if they have not committed any crime. It can also affect US citizens or legal residents if agents act based on racial or linguistic profiling, which can violate their rights. But the Court's decision leaves open whether those constitutional limits will be protected in other proceedings.<\/p>\n<h5><strong>Is this legal? What rights do you have?<\/strong><\/h5>\n<p>The Fourth Amendment protects against unreasonable searches and seizures. That protection exists for everyone, citizens and non-citizens. But this ruling gives ICE more freedom, at least for now, if they combine those factors (language, appearance, type of work, location) with other indicators. A single isolated factor is not enough, according to the Court. <strong>If you, a relative or friend:<\/strong><\/p>\n<ul>\n<li>Do you speak Spanish or do you have an accent?<\/li>\n<li>you work in informal jobs, construction, car washing, day labor, etc.<\/li>\n<li>you frequent areas where other immigrants work (worker bus stops, etc.)<\/li>\n<li>even if you have been in the US for many years, contribute, and live legally or not<\/li>\n<\/ul>\n<p>So this decision poses a real risk of being detained, interrogated, or arrested at the border, airport, or even on the street, without having done anything illegal apart from those factors. The climate of fear may increase, and now more than ever it is important to know your rights and be prepared.<\/p>\n<h5><strong>What can you do to protect yourself?<\/strong><\/h5>\n<p><strong> Take your \u201csecurity package\u201d<\/strong> We recommend always carrying documents that prove your time in the US.<\/p>\n<ul>\n<li>Rental agreements.<\/li>\n<li>Payment receipts.<\/li>\n<li>Medical or school bills.<\/li>\n<\/ul>\n<p><strong> Save digital and physical copies<\/strong><\/p>\n<ul>\n<li>Keep your scans on your cell phone or in the cloud.<\/li>\n<li>Always carry a printed copy.<\/li>\n<\/ul>\n<p><strong> Know your rights<\/strong><\/p>\n<ul>\n<li>You have the right to remain silent.<\/li>\n<li>You are not obligated to open the door if there is no order signed by a judge.<\/li>\n<li>You can ask to speak with your lawyer.<\/li>\n<\/ul>\n<p><strong>Legal consultation prior to travel or interactions: <\/strong>If you are going to leave the country, return, or enter public transportation stations, consider talking to a lawyer to understand the risk based on your case. <strong>Response to arrest or interrogation:<\/strong><\/p>\n<ol>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>You can ask if you are under arrest or if you can remain silent.<\/li>\n<li>Ask if you can speak with a lawyer.<\/li>\n<li>Do not sign anything without legal consultation.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<p><strong>Stay informed and participate in the community: <\/strong>Immigrant rights organizations (ACLU, local groups) and community networks are aware and usually offer workshops, guides, and free assistance.<\/p>\n<h5><strong>&nbsp;<\/strong><strong>What to do if you have already been detained or arrested?<\/strong><\/h5>\n<ul>\n<li>Contact an immigration lawyer as soon as possible.<\/li>\n<li>Ask them to see if your case can have a legal defense, suspension of detention, bail, etc.<\/li>\n<li>Verify if you have rights against abuses (racial profiling, interrogation that did not respect rights).<\/li>\n<li>If you are a citizen or legal resident, your constitutional rights matter too.<\/li>\n<\/ul>\n<h5><strong>Do not lose hope or run out of action<\/strong><\/h5>\n<p>This Supreme Court ruling increases the risk for millions of immigrants, but it does not mean you are defenseless.
