This law completely changed the asylum process in the US by establishing mandatory fees for the first time. Now, applicants face two payments:<\/p>\n<ul>\n<li><strong>Initial fee of $100 dollars<\/strong> to submit the asylum application (Form I-589).<\/li>\n<li><strong>Annual fee of $100 dollars<\/strong> what must be paid each year while the case remains pending.<\/li>\n<\/ul>\n<p>This <strong>US asylum annual fee 2025<\/strong> it is the one that has generated the most doubts and confusion, because it did not exist before and affects thousands of applicants whose cases have been unresolved for years.<\/p>\n<h5><strong>What is the annual asylum fee?<\/strong><\/h5>\n<p>The <strong>annual nursing home fee<\/strong> It is a fee of $100 dollars that the government charges for each calendar year that your application remains pending. Example:<\/p>\n<ul>\n<li>If you applied for asylum in 2023 and your case is still pending by 2025, you will now have to pay $100 in 2025, and then $100 each year until a decision is made on your case.<\/li>\n<li>If you file it in 2025, you will pay $100 when you submit your application (initial fee) and then $100 on your first anniversary if the case has not been resolved.<\/li>\n<\/ul>\n<h5><strong>Since when does the annual fee apply?<\/strong><\/h5>\n<ul>\n<li><strong>USCIS (Affirmative Asylum):<\/strong> USCIS announced that it will start charging the annual fee in the <strong>autumn of 2025<\/strong> to those with a pending case for more than a year. You will receive a notice with instructions to pay online.<\/li>\n<li><strong>Immigration Court (defensive asylum):<\/strong> The law applies from the <strong>July 4, 2025<\/strong>. Although EOIR does not yet have a specific system, judges are expected to demand this payment from those who have already been waiting a year or more.<\/li>\n<\/ul>\n<h5><strong>How is the annual fee paid?<\/strong><\/h5>\n<ul>\n<li><strong>At USCIS:<\/strong> The payment will be <strong>exclusively online<\/strong>. USCIS will send a notice when the time comes, with instructions and a deadline.<\/li>\n<li><strong>In immigration court:<\/strong> For now, there is no option to make this payment in the <a href=\"https:\/\/epay.eoir.justice.gov\/index\" target=\"_blank\" rel=\"noopener\">official portal<\/a>. Stay in touch with your lawyer so you have the latest updates.<\/li>\n<\/ul>\n<h5><strong>Who must pay?<\/strong><\/h5>\n<p>The law did not create exemptions. That means:<\/p>\n<ul>\n<li>All primary applicants must pay.<\/li>\n<li>Children, adults, vulnerable people: no exceptions.<\/li>\n<li>Families that apply together pay only one application fee.<\/li>\n<\/ul>\n<h5><strong>What happens if I don't pay the annual fee?<\/strong><\/h5>\n<p>The annual fee is not optional. If you don't pay:<\/p>\n<ul>\n<li><strong>USCIS<\/strong> can close your asylum case for abandonment.<\/li>\n<li><strong>In court<\/strong>, the judge can order your deportation for breaking the law.<\/li>\n<\/ul>\n<h5><strong>Tips for asylum seekers<\/strong><\/h5>\n<ol>\n<li><strong>Do not ignore USCIS notices.<\/strong> If you receive a notification, pay within the specified timeframe.<\/li>\n<li><strong>In court, take the initiative.<\/strong> Even if they don't remind you, you have to remember to pay every year.<\/li>\n<li><strong>Always keep your receipts.<\/strong> They are your compliance test.<\/li>\n<li><strong>Seek community help.<\/strong> There are organizations that can support you if you cannot afford the payment.<\/li>\n<\/ol>\n<p><br><\/p>\n<p>Although it represents a burden for many immigrant families, <strong>Complying with these fees is essential in order not to jeopardize your case<\/strong>.
