Many people have been detained and told that <em>They are not eligible for bail<\/em>, even after having lived for years in the United States. However, there is a <strong>very important update<\/strong> what changes this scenario and what can reopen the door to request release on bond before an immigration judge.<\/p>\n<h4><strong>What is happening with bail bonds now?<\/strong><\/h4>\n<p>The <strong>November 25, 2025<\/strong>, a <strong>federal district court<\/strong> overturned a decision of the Board of Immigration Appeals (BIA) known as <strong>Matter of Yajure Hurtado (2025)<\/strong>. This ruling is key because <strong>restores the right of many undocumented immigrants to request a bond hearing<\/strong>, something ICE had been broadly denying.<\/p>\n<h4><strong>The case that changed the situation<\/strong><\/h4>\n<p>The case involved a Venezuelan man who had entered the United States <strong>without permission<\/strong> and that, after living here for several years, he was arrested by ICE. The immigration judge denied him bond based on a new ICE argument: that the person was not \u201celigible\u201d for bond because he was considered a <em>\u201cadmission applicant\u201d<\/em>. This interpretation was used by ICE to keep <strong>millions of detained immigrants<\/strong>, even people without a criminal record and with strong family ties in the US. Faced with this, the <strong>Northwest Immigrant Rights Project (NWIRP)<\/strong> sued ICE, arguing that automatically denying bond was illegal. The court <strong>agreed<\/strong> and he ordered that <strong>Bail hearings must be reinstated<\/strong>. <strong>Important:<\/strong> The fault <strong>It does not compel<\/strong> judges to grant bail, but <strong>yes, it mandates that a hearing be held<\/strong>. While the government does not appeal (or until an appeal is resolved), <strong>immigrants nationwide can once again request a bond hearing before an immigration judge<\/strong>.<\/p>\n<h4><strong>Why was ICE denying so many bonds?<\/strong><\/h4>\n<p>To understand this, it is necessary to explain how the law classifies certain immigrants.<\/p>\n<h4><strong>What is an \u201carriving alien\u201d or \u201capplicant for admission\u201d?<\/strong><\/h4>\n<p>Immigration law considers as <strong>\u201cadmission applicants\u201d<\/strong> to people who:<\/p>\n<ul>\n<li>They arrive in the US through a port of entry (airport or border),<\/li>\n<li>They enter between ports of entry without permission,<\/li>\n<li>or intercepted at sea and brought to the US.<\/li>\n<\/ul>\n<p>ICE began to argue that <strong>anyone who entered without permission<\/strong>, regardless of how many years he has been in the country, <strong>is still legally someone who is \u201ctrying to enter\u201d<\/strong>, and that's why <strong>cannot request bail<\/strong>. This interpretation was supported by decisions such as <em>Jennings v. Rodriguez<\/em> and <em>Matter of Q. Li<\/em>, but <strong>many lawyers and judges consider that ICE went too far<\/strong> by applying that logic so broadly. Before this change, the general rule was clear:<\/p>\n<ul>\n<li>If a person was not considered dangerous or a flight risk, <strong>the judge could grant bail<\/strong>.<\/li>\n<\/ul>\n<h4><strong>Who was at greater risk under this policy?<\/strong><\/h4>\n<p>Among the most affected were:<\/p>\n<ul>\n<li>Immigrants who <strong>They entered without permission<\/strong> and were never arrested at the border, even though they have been living and working in the U.S. for years.<\/li>\n<li>People who <strong>they were released at the border<\/strong> to follow their case (for asylum, for example) and then detained sometime later.<\/li>\n<li>People who entered with <strong>parole<\/strong> (including programs like CHNV) and were then detained.<\/li>\n<\/ul>\n<p>For many of these people, ICE argued that <strong>there was no right to bail<\/strong>, regardless of their history or roots.<\/p>\n<h4><strong>What can be done now?<\/strong><\/h4>\n<p>With this new judicial decision, there are several important actions:<\/p>\n<ol>\n<li><strong> Continue requesting bail hearings<\/strong><\/li>\n<\/ol>\n<p>Even if ICE says someone is ineligible, <strong>Immigration judges have the authority to decide<\/strong> and now they must at least hear the case.<\/p>\n<ol start=\"2\">\n<li><strong> Requesting parole (conditional release) directly from ICE<\/strong><\/li>\n<\/ol>\n<p>Especially in cases with:<\/p>\n<ul>\n<li>Medical problems,<\/li>\n<li>Mental vulnerabilities,<\/li>\n<li>Severe humanitarian situations.<\/li>\n<\/ul>\n<ol start=\"3\">\n<li><strong> Prepare with documents<\/strong><\/li>\n<\/ol>\n<p>It is key to store in a safe place:<\/p>\n<ul>\n<li>Evidence of how entry into the country was made,<\/li>\n<li>Documents issued upon release at the border,<\/li>\n<li>Passports, visas, stamps, court notices.<\/li>\n<\/ul>\n<p>These documents can make a difference at a bond hearing.<\/p>\n<ol start=\"4\">\n<li><strong> Speak with an immigration lawyer<\/strong><\/li>\n<\/ol>\n<p>A lawyer up to date with these changes can:<\/p>\n<ul>\n<li>Argue eligibility for bail,<\/li>\n<li>Present alternative strategies as a VAWA or T Visa case<\/li>\n<\/ul>\n<p>This judicial decision <strong>does not guarantee freedom<\/strong>, but yes <strong>return a fundamental right<\/strong>: the right to have a judge hear the case.
