Muchas personas han sido detenidas y se les ha dicho que <em>no tienen derecho a fianza<\/em>, incluso despu\u00e9s de haber vivido a\u00f1os en Estados Unidos. Sin embargo, hay una <strong>actualizaci\u00f3n muy importante<\/strong> que cambia este panorama y que puede abrir nuevamente la puerta a solicitar libertad bajo fianza ante un juez de inmigraci\u00f3n.<\/p>\n<h4><strong>\u00bfQu\u00e9 est\u00e1 pasando ahora con las fianzas?<\/strong><\/h4>\n<p>The <strong>25 de noviembre de 2025<\/strong>, un <strong>tribunal federal de distrito<\/strong> anul\u00f3 una decisi\u00f3n de la Junta de Apelaciones de Inmigraci\u00f3n (BIA) conocida como <strong>Matter of Yajure Hurtado (2025)<\/strong>. Este fallo es clave porque <strong>restablece el derecho de muchos inmigrantes indocumentados a pedir una audiencia de fianza<\/strong>, algo que ICE hab\u00eda estado negando de forma generalizada.<\/p>\n<h4><strong>El caso que cambi\u00f3 la situaci\u00f3n<\/strong><\/h4>\n<p>El caso involucraba a un hombre venezolano que hab\u00eda entrado a Estados Unidos <strong>sin permiso<\/strong> y que, tras vivir aqu\u00ed durante varios a\u00f1os, fue arrestado por ICE. El juez de inmigraci\u00f3n le neg\u00f3 la fianza bas\u00e1ndose en un nuevo argumento de ICE: que la persona no era \u201celegible\u201d para fianza por ser considerada un <em>\u201csolicitante de admisi\u00f3n\u201d<\/em>. Esta interpretaci\u00f3n fue usada por ICE para mantener <strong>a millones de inmigrantes detenidos<\/strong>, incluso personas sin antecedentes penales y con fuertes lazos familiares en EE. UU. Ante esto, el <strong>Northwest Immigrant Rights Project (NWIRP)<\/strong> demand\u00f3 a ICE, argumentando que negar autom\u00e1ticamente la fianza era ilegal. El tribunal <strong>estuvo de acuerdo<\/strong> y orden\u00f3 que <strong>las audiencias de fianza deben volver a realizarse<\/strong>. <strong>Important:<\/strong> El fallo <strong>no obliga<\/strong> a los jueces a conceder fianza, pero <strong>s\u00ed obliga a que se lleve a cabo una audiencia<\/strong>. Mientras el gobierno no apele (o hasta que se resuelva una apelaci\u00f3n), <strong>los inmigrantes en todo el pa\u00eds pueden volver a pedir una audiencia de fianza ante un juez de inmigraci\u00f3n<\/strong>.<\/p>\n<h4><strong>\u00bfPor qu\u00e9 ICE estaba negando tantas fianzas?<\/strong><\/h4>\n<p>Para entender esto, hay que explicar c\u00f3mo la ley clasifica a ciertos inmigrantes.<\/p>\n<h4><strong>\u00bfQu\u00e9 es un \u201cextranjero entrante\u201d o \u201csolicitante de admisi\u00f3n\u201d?<\/strong><\/h4>\n<p>La ley de inmigraci\u00f3n considera como <strong>\u201csolicitantes de admisi\u00f3n\u201d<\/strong> a personas que:<\/p>\n<ul>\n<li>Llegan a EE. UU. por un puerto de entrada (aeropuerto o frontera),<\/li>\n<li>Entran entre puertos de entrada sin permiso,<\/li>\n<li>O son interceptadas en el mar y tra\u00eddas a EE. UU.<\/li>\n<\/ul>\n<p>ICE comenz\u00f3 a argumentar que <strong>cualquier persona que entr\u00f3 sin permiso<\/strong>, sin importar cu\u00e1ntos a\u00f1os lleve en el pa\u00eds, <strong>sigue siendo legalmente alguien que \u201cest\u00e1 intentando entrar\u201d<\/strong>, y por eso <strong>no puede pedir fianza<\/strong>. Esta interpretaci\u00f3n se apoy\u00f3 en decisiones como <em>Jennings v. Rodriguez<\/em> y <em>Matter of Q. Li<\/em>, pero <strong>muchos abogados y jueces consideran que ICE fue demasiado lejos<\/strong> al aplicar esa l\u00f3gica de forma tan amplia. Antes de este cambio, la regla general era clara:<\/p>\n<ul>\n<li>Si una persona no era considerada peligrosa ni riesgo de fuga, <strong>el juez pod\u00eda otorgar fianza<\/strong>.<\/li>\n<\/ul>\n<h4><strong>\u00bfQui\u00e9nes estaban en mayor riesgo bajo esta pol\u00edtica?<\/strong><\/h4>\n<p>Entre las personas m\u00e1s afectadas estaban:<\/p>\n<ul>\n<li>Inmigrantes que <strong>entraron sin permiso<\/strong> y nunca fueron arrestados en la frontera, aunque lleven a\u00f1os viviendo y trabajando en EE. UU.<\/li>\n<li>Personas que <strong>fueron liberadas en la frontera<\/strong> para seguir su caso (por asilo, por ejemplo) y luego detenidas tiempo despu\u00e9s.<\/li>\n<li>Personas que entraron con <strong>parole<\/strong> (incluyendo programas como CHNV) y luego fueron detenidas.<\/li>\n<\/ul>\n<p>Para muchas de estas personas, ICE argumentaba que <strong>no exist\u00eda derecho a fianza<\/strong>, sin importar su historia o arraigo.<\/p>\n<h4><strong>\u00bfQu\u00e9 se puede hacer ahora?<\/strong><\/h4>\n<p>Con esta nueva decisi\u00f3n judicial, hay varias acciones importantes:<\/p>\n<ol>\n<li><strong> Seguir pidiendo audiencias de fianza<\/strong><\/li>\n<\/ol>\n<p>Aunque ICE diga que alguien no es elegible, <strong>los jueces de inmigraci\u00f3n tienen autoridad para decidir<\/strong> y ahora deben al menos escuchar el caso.<\/p>\n<ol start=\"2\">\n<li><strong> Pedir parole (libertad condicional) directamente a ICE<\/strong><\/li>\n<\/ol>\n<p>Especialmente en casos con:<\/p>\n<ul>\n<li>Problemas m\u00e9dicos,<\/li>\n<li>Vulnerabilidades mentales,<\/li>\n<li>Situaciones humanitarias fuertes.<\/li>\n<\/ul>\n<ol start=\"3\">\n<li><strong> Prepararse con documentos<\/strong><\/li>\n<\/ol>\n<p>Es clave guardar en un lugar seguro:<\/p>\n<ul>\n<li>Pruebas de c\u00f3mo se ingres\u00f3 al pa\u00eds,<\/li>\n<li>Documentos entregados al ser liberado en la frontera,<\/li>\n<li>Pasaportes, visas, sellos, notificaciones de corte.<\/li>\n<\/ul>\n<p>Estos documentos pueden marcar la diferencia en una audiencia de fianza.<\/p>\n<ol start=\"4\">\n<li><strong> Hablar con un abogado de inmigraci\u00f3n<\/strong><\/li>\n<\/ol>\n<p>Un abogado actualizado en estos cambios puede:<\/p>\n<ul>\n<li>Argumentar elegibilidad para fianza,<\/li>\n<li>Presentar estrategias alternativas como un caso de VAWA o Visa T<\/li>\n<\/ul>\n<p>Esta decisi\u00f3n judicial <strong>no garantiza la libertad<\/strong>, pero s\u00ed <strong>devuelve un derecho fundamental<\/strong>: el derecho a que un juez escuche el caso.
