Although the name speaks of &#8220;women,&#8221; this law <strong>protects all people regardless of gender<\/strong>.\n\nYou can apply if:\n<ul>\n \t<li><strong>You are<\/strong> the spouse of a U.S. citizen or permanent resident who has physically or emotionally abused you.<\/li>\n \t<li><strong>You are the son or daughter under the age of 21<\/strong> of a U.S. citizen who has abused you.<\/li>\n \t<li><strong>You are the parent<\/strong> of a U.S. citizen over the age of 21 who has abused or mistreated you.<\/li>\n<\/ul>\nIn addition, you must demonstrate:\n<ul>\n \t<li>That you lived with the abusive person.<\/li>\n \t<li>That you suffered physical or psychological abuse.<\/li>\n \t<li>That you have good moral character.<\/li>\n<\/ul>\nEvidence can include medical reports, testimonials, messages, photographs, letters of support, among others. <em>You don&#8217;t necessarily need a police report<\/em>.\n<h5><strong>Is VAWA fraud?<\/strong><\/h5>\nNo. <strong>Applying for VAWA is not fraud.<\/strong>\n\nVAWA has been part of U.S. law for years and is designed to protect vulnerable people.\n\nJust because a person tells their story without other documents doesn&#8217;t mean they&#8217;re committing fraud. Personal stories \u2014 along with other evidence \u2014 are a legitimate part of many immigration cases.\n<h5><strong>Why do some people think it&#8217;s fraud?<\/strong><\/h5>\nThis myth usually appears when:\n<ul>\n \t<li>There is not enough additional evidence and it is only based on testimony.<\/li>\n \t<li>There are misunderstandings about how evidence works in cases of abuse.<\/li>\n \t<li>People without legal knowledge misinterpret complex situations.<\/li>\n \t<li>Videos or comments on social networks amplify conclusions without context.<\/li>\n<\/ul>\nThe truth is that <strong>USCIS knows that many victims do not have official documents of abuse<\/strong> (such as police or hospital reports). That is why the law allows testimony to be considered along with other reasonable evidence.\n\nThe key is not just to say that there was abuse, but <strong>to show evidence that supports it<\/strong> to the greatest extent possible.\n<h5><strong>Is VAWA fraud if you don&#8217;t have &#8220;strong evidence&#8221;?<\/strong><\/h5>\nFiling a request based on your testimony <strong>is not fraud<\/strong> if what you are telling is true.\n\nMany victims do not have physical proof because they did not report out of fear, shame or because they were financially dependent on the abuser. USCIS understands this, and because of this, the applicant&#8217;s sworn testimony <strong>is valid and accepted<\/strong> if it is well documented and supported by other elements.\n<h5><strong>So, when is it fraud?<\/strong><\/h5>\n<ul>\n \t<li>When a person <strong>makes up<\/strong> a story of abuse that never happened.<\/li>\n \t<li>When documents are falsified.<\/li>\n \t<li>When a petition is made without having any real relationship with the abuser.<\/li>\n<\/ul>\n<h5><strong>What if I only have my testimony?<\/strong><\/h5>\nTestimony alone can be sufficient if it is detailed, coherent, and accompanied by any other supporting evidence.\n\nFor example:\n<ul>\n \t<li>Letters from friends or family members who have seen the abuse.<\/li>\n \t<li>Medical or psychological records.<\/li>\n \t<li>Photographs.<\/li>\n \t<li>Call or text message history.<\/li>\n \t<li>Evidence of economic control or isolation.<\/li>\n<\/ul>\nUSCIS does not expect a &#8220;perfect&#8221; case, but a <strong>credible and well-documented<\/strong> one.\n<h5><strong>Does applying for VAWA put you at risk of deportation?<\/strong><\/h5>\n<strong>No. Applying for VAWA does not make you a target for deportation.<\/strong>\n\nUSCIS does not automatically send your case to ICE simply because you ask for this benefit.\n\nNow, if you <strong>don&#8217;t have legal status in the U.S.<\/strong>, and your VAWA is denied, you could be left without legal status \u2014 which <strong>is not the same as<\/strong> automatic deportation. It does not mean that you will be deported automatically or the next day.<\/strong>\n\nFirst, it&#8217;s important to clarify something fundamental: <strong>Only an immigration judge can order your deportation.<\/strong>\n\nThis means that neither USCIS, ICE, nor anyone else can automatically deport you just because you applied for an immigration benefit and were denied.\n\nIf your VAWA application is denied, that <strong>does not trigger an automatic deportation order<\/strong>.
