1. Violence Against Women Act (VAWA) Petitions. Undocumented individuals who have been abused – whether physically, psychologically, economically, or sexually – by a spouse, parent, or child who is a citizen or resident and is at least 21 years old, can apply for permanent residency in many circumstances. 2. T-Visa Applications. Undocumented individuals who are victims of trafficking can apply for T nonimmigrant status, which allows them to stay in the United States if they are willing to assist the police in prosecuting their abuser. Those living in the United States without status are frequently exploited, for example, by an employer who threatens or hints that they could be deported if they do not provide the work demanded of them. Even individuals who are trapped in a relationship in which a non-citizen partner demands they perform domestic service may be eligible.
