The Trump administration has decided to revive an old World War II policy that requires certain immigrants to register under a new foreign registration requirement. This measure affects three specific groups of people, and non-compliance could result in criminal penalties, fines, and even prison time.
Who must register?
1️⃣ Individuals who entered the U.S. unlawfully without inspection, admission, or parole
- They do not have fingerprints registered with immigration.
- They do not have a Green Card, visa, or work permit.
- They are not in the process of being deported.
- They must complete an online form and submit their information.
2 Canadians who entered via the land border
- They have not applied for any immigration benefits such as a work permit or a Green Card.
- They have been in the US for more than 30 days and are over 14 years old.
3 DACA or TPS applicants without proof of registration
- Include those who applied for DACA between 2021 and 2022 and whose case became stuck in litigation.
- If you entered the country without going through an inspection and do not have a work permit or any other active immigration status, you must register.
Who has already registered?
Foreign nationals who have already completed their registration include:
✅ Legal permanent residents (Green Card holders).
✅ Individuals on parole in the U.S. under INA 212(d)(5), even if their parole period has expired.
✅ Nonimmigrants admitted to the U.S. who were issued an I-94 or I-94W form (either paper or electronic), even if their period of admission has expired.
✅ All foreign nationals currently in the U.S. who received immigrant or nonimmigrant visas prior to their arrival.
✅ People whom DHS has placed in deportation proceedings.
✅ People who have been issued a work permit.
✅ Individuals who applied for permanent residence using Forms I-485, I-687, I-691, I-698, or I-700, even if their application was denied.
✅ People who have been issued a Border Crossing Card.
What is the real purpose of this measure?
This policy appears to be designed to encourage self-deportation. Given that the Trump administration faces logistical challenges in carrying out mass deportations (lack of space in detention centers, limited resources, etc.), this measure puts pressure on immigrants to turn themselves in voluntarily.
Registration is mandatory for everyone over the age of 14 who have been in the US for more than 30 days. In addition, they are required to carry proof of their registration with them at all times. In the case of minors, parents must ensure that they are also registered.
